Letter to the editor Sunshine Cost Daily

Dear editor,

how disappointing it was that your newspaper has grabbed the Murdoch madness so quickly and viciously.  Your editorial calling for Mr Gordon to stand down is a disgrace, but one to be expected from a newspaper part owned by the company that hacked a dead school girl's  phone for profit.

The law is simple in Queensland, commit a crime and you get prosecuted by a court of law, not a newspaper, then you do your time for the crime.  After a set period your convictions become spent.  If you have been a good boy and become a legitimate part of society again you are allowed to forget about your evil past.  This is when a crime is spent.  A person never has to declare spent convictions, that is the idea of the law.

From what I have read Mr Gordon has not had any requirement to declare or admit to any of his past, spent convictions.  A police check initially showed up no convictions and a second one did exactly the same.  It seems that only after the intervention of Mr King, the infamous federal MP who considers drunk women are asking to be raped, only after his political muck raking was anything brought to the fore.

Has Mr King broken the law by disclosing another man's spent convictions or is the fact Mr Gordon is black meant this doesn't matter?

Your paper finally stopped publishing anonymous hate letters and then turned Murdoch on us.

yours
Tony Magrathea

statement of claim sent to Tony Abbott breach of contract

Anthony John (Tony) Abbott of Level 2, 17 Sydney Road, Manly NSW, 2095, I am writing to seek relief for breach of contract to the sum of $1,460,800.00.

On 18 September 2013 you swore an oath of office to well and truly serve the people of Australia.  This is a verbal contract between you and me as I am one of the people of Australia.

You are in breach of that contract in that the Department of Prime Minister and Cabinet in FOI 2014/159 stated that your renunciation of British citizenship papers do not exist.  As the renunciation papers do not exist you are in breach of the Australian Constitution S44 and therefore your verbal contract to well and truly serve me as a person of Australia is broken.

I seek relief of $200 per day as set down in the Australian Constitution S46.  As you have been in parliament 7304 days as of today,26th of March 2015, a total of $1,460,800.00.

If I have not received the money by 17 April 2015 I will take the matter to court.

Yours

Tony Magrathea

A parliamentary page on oaths would seem to indicate that the oath of office is in fact a verbal contract between the parliamentarian and the people of our country.   Though parliament can no longer expel members of the senate or house.

So many large legal firms don't want to touch this action,I guess their bribes are in place and they don't want to risk those.

If you want to help with any court costs and fees please consider donating some loose change.  If you can offer legal advice or wish to take on the case pro bono please contact me via twitter direct messages, @dickybeacholdie.

letter to Dion Dassanayake

If you would like to keep me out of poverty, please press the button and thank you all that do.

Dion Dassanayake is a journalist for the Daily Express  in the UK

Dear sir/madam

writing to congratulate Dion Dassanayake on his piece about Tony Abbott.  Since then Abbott has gone on to say that child abuse in our dinky little concentration camp on Nauru is things happen.

He is an embarrassment, but more so your very own Theresa May and David Cameron are protecting him, I believe also that William Hague played a big part in ensuring Abbott was not questioned about his British citizenship.

In Australia it is illegal for a member of parliament to hold nationalities other than Australian, our constitution forbids it.  Mr Abbott was born in London to a British father and Australian mother, he got automatic British citizenship.  In 1981 he applied for Australian citizenship to comply with the Rhodes Scholarship rules, he had applied as a Briton for something that was only supposed to be available for Australians.  he got the Australian citizenship and became a dual national.

He entered parliament in 1984 and because of twee little rules written by his own party the Electoral Commission can not question someone's nationality, they have to believe a politician.  In 2014 Mr Abbotts department of Prime Minister and Cabinet released an FOI request, FOI/2014/159 stating the renunciation paperwork does not exist.  If Mr Abbott is a dual national he has signed 8 flase declarations for the Australian Electoral Commission.  The Australian federal police are reluctant to act because the Commissioner, Mr Colvin, has been promised the top job in Homeland Security if that is ever set up.

In January an opposition MP finally dared to ask Mr Abbot about his dual nationality, but its been 8 weeks and still no reply. Her political party has now decided she is not to ask further.

In September 2014 I contacted your Home Office to see if they had a copy of Mr Abbotts renunciation papers for his British citizenship.  The request went well past the 3 weeks which is the legislated for your FOIs, the civil servant I spoke to about the delay said "off the record" that Mr Hague from the Foreign Office had called in the request to protect his conservative friend and Oxford old boy chum Tony Abbott. The official response from Home Office was that they could neither confirm nor deny any renunciation forms existed.  requests to Ms May and Mr Cameron to use their authority to determine what hte truth was have been ignored. I have not had anything other than the computer generated initial response.

Maybe your newspaper would like to follow up this story and ask Ms May and Mr Cameron and Mr Hague why they are protecting someone who may be a criminal fraud acting as prime minsiter in Australia.

My blog is quite lengthy and details a lot of what is and isnt happening in Australian politics.

Cheers and thank you and pass on a pat on the back to Mr Dassanayake

yours sincerely

tony magrathea

as a funny aside to this, Mr Abbotts mother returned to Australia as an assisted immigration passenger on a ship, we sweetly call them ten pound poms.  The Australian National Archives have no record of Mrs Abbott renouncing her Australian citizenship, she she probably came to Australia as an illegal boat person.

letter to Jason Clare MP

Noticed you mentioned on twitter about the NBN fiasco.

The problem can be solved if one of you in opposition asked a question in parliament about Abbotts citizenship.  If I am right he goes for fraud, 8 false declarations to the AEC and all LNP are then brought before the police for ignoring or hiding the crimes.  They have been told as have all labour party members.  All police forces have been advised to watch for the dismissal of Abbott so they can question the LNP members about covering up his crimes.

Angus at Terri Butlers office told me labour is only interested in the agenda and Terri has been effectively silenced in her asking Abbott about his citizenship.  To the 600,000 who tweet or retweet what I twitter this is not good.  http://tonymagrathea.blogspot.com.au/2015/01/a-reply-from-hon-terri-butler-mp.html  Is the blog detailing what Terri dared to ask.  Its been more than 8 weeks since she sent that letter, to us on twitter that is a huge middle finger, total disrespect of a member of parliament.

As you MPs wont look after us Australians, the Australians are looking after themselves.  I am starting breach of contract proceedings against Tony Abbott at the end of the month.  His oath to god and queen said  "I, Anthony John Abbott, do swear that I will well and truly serve the people of Australia,"

To truly serve the country means obeying all laws, to truthfully be an honest politician, his contract with the people of Australia has been broken because he hasn't renounced his British citizenship.

The court case will at least get the truth out and then the government. Be prepared. And please don't spread this through the party, I intend this to be a bit of a surprise.  It is a crying shame you politicians are so weak at the knee you can not dare to ask.  From speaking to your foreign born MPs all of them comply with the law, so why not the leader of Team Australia?

The labour party has lost so many votes over this, maybe a good deal of the heartland 600,000 who occasionally see my tweets, even if it is just the 27,000 who signed the petition asking Bill Shorten & Tanya Plibersek to ask the question it is still a huge risk for your marginal seats.

What ever good there is in having an idiot as Prime Minister will be lost because we have an opposition who are kow towing with him to keep him there.

Lets hope the fan and poo shake hands gleefully at the end of the month,

ciao

For Mr Pyne

Hon C Pyne Minister for Education

Dear Mr Pyne,

what would you consider a normal amount of time for an MP to answer a voters questions?  What would be normal to answer a fellow MPs questions?

On 23 January Ms Butler MP for Griffith asked Mr Abbott to clarify problems with regard to his British citizenship, it seems he hasn't bothered renouncing his citizenship. A link to the blog detailing the letter is here

Is 7 to 8 weeks just slack office keeping, is his Chief of Staff being lax in running the Office or is it more approaching the realms of a middle finger for Ms Butler?

I have about 25,000 people following my blog, which includes the one above relating to Ms Butlers' letter.  I have on good days up to 600,000 people following my twitters.  A lot of people are interested in the questions I ask and which Ms Butler has also asked.

Will you please ask Mr Abbott to answer Ms Butler and explain tot he country when he renounced his British citizenship.  He holds a law degree, so ignorance of the law is not a problem, one thing the law degrees at Sydney University did and still do, is highlight our constitution.

I look forward to a rather speedier response than that offered by Mr Abbott.

Yours
Tony Magrathea

Another to Abbott

I first wrote to you in February 2014, last year, and 16 times since then.
Ms Terri Butler a Member for Parliament wrote to you with the same query on 23 January 2015.

I have 25,000 reading my log regularly, most especially this one
I have upwards of 600,000 read my tweets on a good day.  A lot of people hanging on your response to Ms Butler.
It is over 7 weeks now since Ms Butler asked you about your British citizenship, 7 weeks without a reply.

According to all of the senior members of the party I have spoken to you should have responded the same week.  I doubt this is incompetent staffing, you are the reason there is no reply. Are you really giving the none verbal middle finger to another Member of Parliament?

When will you answer?

Answer your voters, answer fellow MPs, I am sure the 600,000 who occasionally follow my twitters will be only too glad to express their views when asked.

AAT, at least I tried

This blog will remain private until the Administrative Appeals Tribunal has decided what they are going to do.

I've sent off a request that they over rule the Australian Electoral Commissions decision not to press or investigate possible fraud charges against Tony Abbott.

They claim they are constrained by law as to what they can look at with regards to candidates, I am stating that as public servants and under the ACT and Federal crimes act they must at least pass on the possibility of a fraud crime to the Australian Federal Police.

The AEC can not determine a crime hasn't happened just because their regulations say they can;t investigate, an alleged crime has been brought to their attention which involves them through acceptance of fraudulent declarations by a candidate.

So until then this will remain a little bit private.

And no longer private, the AAT has decided there is nothing they can do because the AEC acted legally in all of their rules and decision making processes.  The AAT can not make a government authority press criminal charges.

Up to parliament I suppose.

Brough etal

You lot don't like me.  But I am a chatty person and talk to a lot of locals in your electorate.
Today was a hardware shop, garden nursery, second hand shop, newsagent, green grocer, baker, butcher.  All talkative like me and all sick of governments at all levels just ignoring people.

They complain about emails not being answered, twitters being ignored, they should try me.  Most of the LNP block me on twitter because I dare to ask questions.  Even facebook posts go unanswered by all levels of government.

They want less charges, they want people working so that they can afford to spend in their shops. They ant less taxation and more spending.  Sounds impossible but it can be done if only someone in government would listen to what is being said.

I don't know how many times this blog post has been read and commented on on twitter and facebook, thousands of times.  A simple fix which cuts out all government charges and taxes at all levels, which in turn allows workers to spend most of what they earn. That spending would be done in local businesses.  The local businesses would then need to employ more people to keep up with the extra demand.

Added side effects to this idea is if a foreign company earns money in Australia they pay the transaction charge in Australia, if someone wants to put their money in an offshore account, they pay the transaction charge to get it there and then pay when they bring it back on shore.  State governments would be able to spend what their economies allow them to, if they run a successful economy they have more income form the transaction charge.  ditto for federal, I would imagine that all international transactions, sales, movement of money, imports would get the transaction charge and this would more than cover current and future spending.

The star event is that tax scams would be none existent and the black market tradies and drug dealers would be done out of business because all transactions would be electronic.

Kenya has a similar system in place already for mobile phone transactions.Instead of cash or eftpos they use their mobile phone to transfer funds to retailers.  This allows businesses and people to transact safely in the wilds of deepest darkest Africa, the BBC had a world service program about it.

http://tonymagrathea.blogspot.com.au/2014/09/death-and-taxes.html  The blog

Apparently no one on your side of politics has read it, Andrew Leigh has read it but refuses to comment.  The 2% charge may have to be tweaked, its been 30 years since I worked in Taxation so my figures may be out a bit.  The idea is free to use, even Harvard School of Economics thinks the cashless society is the best way of combating tax fraud and the drug trade.

Have a read, I know your Queensland mates don't like reading, Macdonald showed that in his disgusting rants about the Human Rights Commissioner.  I listen to the people, I actually talk to people who aren't party members form either side of politics and a huge dramatic change has to be made.  Its only a couple of hundred words and if Mike Codd is still in Taxation he can tell you if the 2% is good or not.

As a PS get your parliamentary colleagues to unblock the people in twitter and facebook and start answering on both those forums.  Pretty sure it is illegal for an MP of any sort to block voters from contacting them and tell Joe Hockey the $17 charge in facebook to message him is illegal and the SMH is using that charge to get off the court case he is pushing against them.

Letters to Mr Porter and Tudge, parliamentary secretaries to PM

Dear Mr Tudge/Porter

As parliamentary secretary you might be able to advise what is a reasonable or normal time for the Prime Minister to respond to an MP?  Ms Butler wrote on my behalf and that was nearly 6 weeks ago.

A copy of her letter is  here

I tried phoning Mr Abbotts office after 3 weeks and had the most astonishing phone conversation, absolutely astounding. Is the transcript and copy of the audio.

Why does your political party refuse to question Mr Abbott about his lack of renunciation papers for his British citizenship?

It is very unusual that someone would try to hide their renunciation of British citizenship, especially when proclaiming he leads team Australia.

You are well aware Mr Abbott was born in England to a British father, that's automatic British citizenship, got Australian citizenship in 1981 to get the Rhodes dollars and then joined parliament in 1994.

In October 2014 his Department of Prime Minister and Cabinet advised that the renunciation papers for his British citizenship do not exist.  That FOI/2014/159 is here

Mr Abbott has a family fairy story where he got Australian citizenship by descent.  Trouble is Mum renounced her Australian citizenship to get the ten pound pom boat trip (or was she an illegal boat person roflmao)

He applied for Australian citizenship in the normal way, which is now a secret file in the National Archives of Australia. Citizenship normally or by descent doesn't trump the British citizenship, he needs to fill in a form and pay a fee in London which hasn't happened.  That document does not exist so he is illegal

Will you please ask and more importantly let the Australian public know.

You are a bush person, from here and Nigeria so I know I can speak or at least type in a fair dinkum sort of way,no offence meant, it's just the way I believe we are with each other.

Why does your political party refuse to question Mr Abbott about his lack of renunciation papers for his British citizenship? Especially since you did it legally and within the constraints of our constitution.

The right wing media are calling birther, but a birther was a Tea Party racist in the USA who couldn't believe Mr Obama had a legitimate birth certificate.  We know Abbott was born British,we know Abbott got Australian citizenship in 1981, whats missing is the renunciation.  A phone call to his office brought up several things including confirmation the FOI mentioned above is correct.  http://tonymagrathea.blogspot.com.au/2015/02/a-phone-call-to-pms-office.html  The audio for the phone call is here http://federalicacnow.com/podcast/?name=2015-02-16_abbotts_office_canberra_13_09-23-01_aest_2015_conv.mp3  I got the phone call legally,I did advise Mr Abbotts staffers I was recording the call and was told I could publish anything I wanted to at the end of the call.

I do hope you can help to have this man brought before the AFP to explain why he signed 8 false declarations for the Australian Electoral Commission.

thanks
